Article 1 (Purpose)
These Terms of Use (the “Terms”) set out the basic matters governing the rights, obligations, responsibilities, and conditions of service between ROKIT AMERICA, Inc. (the “Company”) and users in connection with the use of content provided on the Company’s website located at https://rokitamerica.com (the “Website”).
Article 2 (Effect of and Amendments to the Terms)
1. These Terms take effect when they are made available to users by being posted at the bottom of the service pages on the Website.
2. A user’s continued access to or use of the Website constitutes consent to these Terms.
3. The Company may amend these Terms to the extent such amendments do not violate applicable laws, including laws regulating terms and conditions. Amended Terms take effect upon posting in the same manner as set out in Paragraph 1.
4. Use of the Website and related content after notice of any amendment constitutes acceptance of the amended Terms.
Article 3 (Definitions)
1. “Website” means the Internet site operated by the Company to provide general information relating to its business, technology, research, public relations, investor relations, and recruitment.
2. “User” means any individual or entity that visits the Website or uses the content and services provided thereon.
3. “Content” includes all text, images, data, audio, video, programs, files, and other materials provided through the Website.
4. Terms not defined herein shall have the meanings given by applicable laws and generally accepted practices.
Article 4 (Services and Provision)
1. Through the Website, the Company provides general information related to its business, technology, products, research, public relations, and investor relations.
2. The specific content or menu structure of the Website may be changed at the Company’s discretion, and operation of all or part of the Website may be suspended or restricted as necessary.
3. To the extent permitted by applicable law, the Company shall not be liable for damages suffered by Users arising from the interruption, modification, or errors of the services, unless caused by the Company’s willful misconduct or gross negligence.
Article 5 (Intellectual Property)

3. To the extent permitted by law, the Company shall not be liable for damages arising from the User’s use of external links, third-party content, or downloadable materials on or through the Website, unless caused by the Company’s willful misconduct or gross negligence.
4. The Company shall not be liable where services are suspended due to force majeure events such as natural disasters, system failures, or communication disruptions.
5. The limitations in this Article do not apply where liability limitations are not permitted by applicable law.
Article 7 (Medical Information)
The Website may contain general information on medical conditions and their treatment. Such information is provided for informational purposes only and is not intended to replace advice provided by a physician or other qualified healthcare professional. Article 8 (User Obligations)
Users shall not:

Article 9 (Personal Information Protection)
1. Personal information provided by Users in the course of inquiries or use of services is processed in accordance with the Personal Information Protection Act and other applicable laws, and the Company’s Privacy Policy.
2. The Company will not use personal information for purposes other than those set out in the Privacy Policy, and where a new purpose arises or disclosure to a third party is required, the Company will notify the User of such purpose at the time of use or disclosure and obtain consent, except where otherwise permitted by law.
3. The items collected, retention periods, and purposes of use are available in the Privacy Policy.
Article 10 (External Links and Third-Party Sites)
1. For convenience, the Website may contain links to third-party websites. The provision of links alone does not imply any partnership, endorsement, or agency relationship with such sites or their operators.
2. The Company does not guarantee the operation of third-party websites, the reliability of their information, or the results of their use; use of such sites is governed by their respective terms.
3. The Company is not a party to, and assumes no legal responsibility for, transactions or disputes arising from the User’s use of linked websites.

Article 11 (Applicable Law and Use Restrictions)

Article 12 (Governing Law and Jurisdiction)
These Terms are governed by the laws of the Republic of Korea. Any disputes arising in connection with the use of the Website shall be submitted to the court having jurisdiction over the location of the Company’s head office; provided, however, that if the Company and the User agree otherwise in writing, such agreement shall prevail.
